 NLRB Poster Requirement Deadline: April 30

April 30, 2012, is the new deadline for nearly all private sector for-profit and not-for-profit nursing facilities and assisted living communities to display posters informing employees of their rights under the National Labor Relations Act (NLRA), according to the National Labor Relations Board (NLRB).

The effective date for private-sector employers to post the information had been previously postponed by NLRB.
“The notice should be posted [via an 11x17-inch poster] in a conspicuous place, where other notifications of workplace rights and employer rules and policies are posted,” NLRB says on its website. “Employers also should publish a link to the notice on an internal or external website if other personnel policies or workplace notices are posted there.”

Compliance with the poster requirement will not be audited by NLRB—it does not audit workplaces or initiate enforcement actions on its own, nor does it have the ability to assess fines or penalties. However, if an employer’s failure to post the notice is brought to the to NLRB’s attention, the board will assume that the employer was unaware of the rule and will comply “when requested by [an NLRB] agent.”

If an employer “knowingly and willfully fails to post the notice, that failure may be considered evidence of unlawful motive in an unfair labor practice case involving other alleged violations of the NLRA,” the board says on its website.

The poster is required to be 11 x 17 inches in color or in black and white. When printing to full size, be sure to set the printer output to 11 x 17 or print two 8.5 x 11 pages and tape them together.

The poster is currently available in 24 languages, including English. NLRB is translating the poster into additional languages, which will be posted on its website as they become available.
